PCD 1371 National Police Chiefs’ Council (NPCC) – International Crime Coordination Centre (ICCC) Grant Funding from National Crime Agency (NCA) 

This paper seeks approval to accept grant funding of £3,500,000 from the National Crime Agency (NCA) to continue funding the National Police Chiefs’ Council (NPCC) International Crime Coordination Centre (ICCC) for the remainder of the financial year.  There is no financial exposure for MOPAC. 

The Deputy Mayor for Policing and Crime is recommended to:  

 Approve MOPAC to receive, on behalf of the NPCC, the £3.5M 2022/23 additional funding provided by the NCA to guarantee operational continuity of the ICCC until It is fully transferred to the Joint International Crime Centre (JICC) within the NCA by 31st March 2023.

PART I - NON-CONFIDENTIAL FACTS AND ADVICE TO THE DMPC

  1. Introduction and background
    1. MOPAC hosts the National Police Chiefs’ Council  (NPCC). On behalf of the NPCC in June 2022 MOPAC approved (PCD1203) the acceptance of National Crime Agency (NCA) funding for the International Crime Coordination Centre (ICCC) operated by the NPCC. This was for the period from 1 April 2022 until 31 October 2022 when the ICC was expected to merge with the NCA international crime function to create the Joint International Crime Centre (JICC).
  1. Issues for consideration
    1. As a result of delay in the finalisation of the merger from October 2022 until end March 2023 the NCA has agreed the award of a further £3,500,000 to fund the ICCC for the whole of 2022/23. 
  1. Financial Comments
    1. The NPCC have assured that the estimated costs will be fully funded from the NCA grant. Any costs not met by the NCA grant funding will be funded from the NPCC budget and reserves. There is no financial exposure for MOPAC.
  1. Legal Comments
    1. Under Schedule 3, paragraph 7 (1) Police Reform and Social Responsibility Act 2011 (the 2011 Act) MOPAC has incidental powers to “do anything which is calculated to facilitate, or is conducive or incidental to, the exercise of the functions of the Office.” Paragraph 7 (2) (a) provides that this includes entering into contracts and other agreements.  DLS consider that these powers are sufficiently broad to permit MOPAC to enter into the grant agreement.
    1. Para 4.8 of the MOPAC Scheme of Consent and Delegation provides the DMPC with delegated power to approve all offers made of grant funding
  1. GDPR and Data Privacy
    1. MOPAC will adhere to the Data Protection Act (DPA) 2018 and ensure that any organisations who are commissioned to do work with or on behalf of MOPAC are fully compliant with the policy and understand their GDPR responsibilities. 
    1. NPCC assure that the receipt of funding does not involve the use of personally identifiable data of members of the public, so there are no GDPR issues to be considered.
  1. Equality Comments
    1. MOPAC is required to comply with the public sector equality duty set out in section 149(1) of the Equality Act 2010. This requires MOPAC to have due regard to the need to eliminate discrimination, advance equality of opportunity and foster good relations by reference to people with protected characteristics. The protected characteristics are: age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation.
    1. The NPCC report that there are no equality implications arising from acceptance of this grant funding.
