Executive summary
MOPAC receives from the Home Office Counter Terrorism (CT) grants which are allocated by the National CT Policing HQ into specialist units across the country, the largest of which is the CT Command in London. The CT policing grant and priorities are governed under the national CONTEST strategy through a Home Office chaired Police Counter-Terrorist Board. MPS also undertake covert activities.
It is proposed that the Deputy Mayor for Policing and Crime, under paragraph 1.7 of the MOPAC Scheme of Consent and Delegation (October 2016), delegate to the Chief Executive Officer of the Mayor’s Office for Policing and Crime the authority to take decisions on the MPS and CT grant-funded expenditure on covert capabilities.

1. Introduction and background
1.1. MOPAC receives from the Home Office Counter Terrorism (CT) grants which are allocated by the National CT Policing HQ into specialist units across the country, the largest of which is the CT Command in London. In addition, the MPS undertakes covert activities funded from its resources.
1.2. As MOPAC is the legal entity for the contracts awarded under these funding streams it has a duty to ensure the appropriate allocation of resources to priorities and the achievement of value for money.
2. Issues for consideration
2.1 Approving the delegation to the Chief Executive of MOPAC will meet the requirement for decisions relating to contract awards and/or to approve funding for the CT function and the MPS’s CT Command, which focus on covert activities and where there is a requirement to have Developed Vetting (DV) to discuss these decisions with officers from the CT Policing function.
2.2 Delegation to the Chief Executive of MOPAC, does not remove the DMPC’s right to be sighted on all MOPAC contract awards and variations. Under the Scheme of Delegation and Consent section 4.14, the DMPC reserves the right to call in any contract award for £500,000 or above and all contract variations and extensions to contracts with an original value of £500,000 or above.

4.1 There are no legal implications arising from this decision. At paragraph 1.7 the MOPAC Scheme of Delegation and Consent states that “the DMPC may in addition, from time to time make specific delegations to officers within MOPAC” and that “staff are authorised to exercise decision making within their area of responsibility subject to appropriate delegations”.
