Executive summary
The Service Integration and Management (SIAM) Contract, which was signed with Atos in 2015 as part of the Total Technology Programme – Infrastructure (TTPi), is due to expire later this year. MPS has initiated a procurement for the replacement for SIAM and the other Tower Services, under the Pegasus programme.
In 2016, a significant Change Request (Solution Delivery Integration Management (SDIM)) was added to this contract to procure services from Atos to manage the delivery of new solutions and projects (Business Portfolio Management Office), integration testing (Test Team), and data integration (Data Team).
The new Pegasus procurement will deliver a Run and Maintain service only. There will not be provision for new solutions and projects delivery. In order to maintain continuity, MPS intend to enter a new Agreement with Atos for the SDIM services by a direct award to Atos under the CCS RM3804 Tech Services 2 framework.
Recommendation
The Deputy Mayor for Policing and Crime is recommended to:
1. Approve Direct award of a new Solution Delivery Integration Management (SDIM) contract to Atos in order that they manage the Business Portfolio Management Office (BPMO), Test Team, and Data team at a revenue cost of £2.5m p/a to a maximum total of £12.5m. This is a contract duration of 2 years (with options of 2+1 years extensions) within the 5 years maximum permitted by the CCS RM3804 Tech Services 2 framework. This is not a request for additional funding or budget growth and the revenue costs will be funded from the MOPAC Approved Digital Policing (DP) Budget.
2. Note that MPS may terminate early with 180 calendar days’ notice.
Non-confidential facts and advice to the Deputy Mayor for Policing and Crime (DMPC)
1. Introduction and background
1.1. The impending Pegasus business case will not include Solution Delivery Integration Management (SDIM) services as they are not to be included in the Pegasus Procurement. The new Pegasus model is designed to be run and maintain service-only, and not to include any new solutions delivery scope. In order to maintain continuity of SDIM services the MPS intend to let a new contract with Atos to replace the current SDIM service, with the intention that this is managed in a Public Contracts Regulations 2015 (PCR 2015) compliant way by a direct award to Atos under the CCS RM3804 Tech Services 2 framework.
1.2. There are currently three services provided within the SDIM service – the SDIM service forms part of current SIAM towers contract – to enable Digital Policing (DP) Solution Delivery to manage the delivery of new solutions and projects (BPMO), integration testing (Test Team), and data integration (Data Team).
1.3. These 3 existing teams have established and effective working practices and, in renewing with the existing supplier and keeping the teams intact, continuity of service can be maintained during and after the transition to the Pegasus model. The teams are staffed by experienced and knowledgeable people, some of whom were originally MPS staff who were Tupe’d across to Atos as part of the SIAM contract.
2. Issues for consideration
2.1. The key issues to take account of are:
• Timing to ensure no break in services from the end of SIAM contract expiry.
• Maintaining continuity of service within the Test, Data and BPMO teams, as Atos personnel are already working on many critical projects.
3. Financial Comments
3.1. The revenue cost of the contract will be for a maximum of £12.5m over 5 years. This will be funded from the MOPAC Approved Digital Policing (DP) Budget.
4. Legal Comments
4.1. The Mayor’s Officer for Policing Crime is a contracting authority as defined in the Public Contracts Regulations 2015 (“the Regulations”). All awards of public contracts for goods and/or services valued at £189,330 or above will be procured in accordance with the Regulations.
4.2. Paragraph 4.13 of the MOPAC Scheme of Delegation and Consent (“the Scheme”) provides that the Deputy Mayor for Policing and Crime (DMPC) has delegated authority to approve the procurement strategy for all revenue and capital contracts of a total value of £500,000 or above and to approve all contract exemptions for £100,000 or above.
4.3. Paragraph 4.15 of the Scheme provides that the DMPC has delegated authority to award MOPAC contracts with a total value of £500,000 or above.
4.4. The Public Contracts Regulations 2015 (PCR 2015) apply to this procurement. Services are being procured via a Government framework agreement (Crown Commercial Services Technology 2 Framework Agreement). External legal advisors have confirmed this is a compliant procurement route and have assisted the MPS in completion of the relevant contract documents.
5. Commercial Issues
5.1. Procurement is through a direct award to Atos under the CCS RM3804 Tech Services 2 framework. This is a compliant procurement route.
5.2. The contract is for an initial duration of 2 years (with options of extensions for a further 2+1 years) within the 5 years maximum permitted by the CCS RM3804 Tech Services 2 framework. Under the contract the MPS may terminate early with 180 calendar days’ notice. The total contract value for 5 years is £12.5m.
6. GDPR and Data Privacy
6.1. The MPS is subject to the requirements and conditions placed on it as a 'State' body to comply with the European Convention of Human Rights and the Data Protection Act (DPA) 2018. Both legislative requirements place an obligation on the MPS to process personal data fairly and lawfully in order to safeguard the rights and freedoms of individuals.
6.2. Under Article 35 of the General Data Protection Regulation (GDPR) and Section 57 of the DPA 2018, Data Protection Impact Assessments (DPIA) become mandatory for organisations with technologies and processes that are likely to result in a high risk to the rights of the data subjects.
6.3. The Information Assurance and Information Rights units within MPS will be consulted at all stages to ensure the Service meets its compliance requirements.
6.4. The SDIM Service does not use personally identifiable data of members of the public, so there are no GDPR issues to be considered.
