Executive summary

Under the Greater London Authority (GLA) Act 1999, the Mayor has a duty to keep under review the GLA Main and GLA Side Roads, which make up the Transport for London Road Network (TLRN). The authority to make amendments to the TLRN has been delegated to the Assistant Director of Transport, Infrastructure and Connectivity, in accordance with paragraph 6.2 of the Mayoral Decision Making document (scheme of delegation). 

Transport for London (TfL) in consultation with the London Boroughs will, from time to time, undertake such a review and following agreement with the relevant London Boroughs officers amend the GLA Designation Orders for GLA Roads and GLA Side Roads, and Special Parking Area Orders as required to alter the extent of the TLRN.

This Decision is to approve a clarification to the existing GLA Roads (No. 3) Designation Order 2008 (Appendix C) to provide a more accurate description of the extent of the unnamed slip roads off and on to Hillingdon Circus in the current GLA Road Designation Order. The Decision will also remove reference within the Designation Order to a defunct roundabout. 
 

Decision

That the Assistant Director of Transport, Infrastructure and Connectivity approves the correction of the Designation Order to better define the extent of the slip roads on and off Hillingdon Circus and remove a defunct roundabout by signing the new order, The GLA Roads (No.3) Designation Order 2008 Variation Order 2023 (Appendix A).

Part 1: Non-confidential facts and advice

1.1    Under the Greater London Authority (GLA) Act 1999, the Mayor has a duty to keep under review the GLA Main and GLA Side Roads, which make up the Transport for London Road Network (TLRN). The authority to make amendments to the TLRN has been delegated to the Assistant Director of Transport, Infrastructure and Connectivity, in accordance with paragraph 6.2 of the Mayoral Decision Making document (scheme of delegation). 

1.2    TfL in consultation with the London Boroughs will, from time to time, undertake such a review and following agreement with the relevant London Boroughs officers amend the GLA Designation Orders for GLA Roads and GLA Side Roads, and Special Parking Area Orders as required to alter the TLRN expanse. 

1.3    There have been some Highway discrepancies due to interpretation of the existing GLA Roads Designation Order where one slip road can be difficult to distinguish from the others.

1.4    TfL and London Borough of Hillingdon have agreed to redefine the description of Hillingdon Circus where Western Avenue meets Long Lane as per the details provided in Appendix A.

1.5    A roundabout at the junction of Western Avenue (A40), 2 items of Unnamed Off Slip Roads (A40) and two items of Unnamed On Slip Roads (A40) were previously reviewed as part of a consolidation exercise of the GLA Roads under a Mayoral Decision (MD3052) on 13 March 2008.

1.6    The Head of Network Performance at Transport for London has confirmed that this request meets all technical, operational and procedural requirements of the Highway and/or Traffic Authority and has been verified for GLA approval.

1.7    TfL has provided a draft of the amended The GLA Roads (No.3) Designation Order 2008 Variation Order 2023 (Appendix A) that proposes that the Highway and Traffic Authority statuses will remain the same and the new descriptions added.   
 

2.1    The objective is to better define the lengths of road that The GLA Roads (No. 3) Designation Order 2008 refers to. This will avoid future doubt by clarifying in the Order each on and off slip by its direction of travel, so that it becomes clear which length of road the description applies to. A map showing this change is included at Appendix B and a description of the changes is included at Appendix A. 

3.1    The Mayor and the Greater London Authority (GLA) are required to comply with the Public Sector Equality Duty as set out in section 149 of the Equality Act 2010 when exercising their functions. Section 149 requires the Mayor and the GLA (and anyone exercising powers on their behalf) to have due regard to the need to:
•    eliminate unlawful discrimination, harassment, victimisation and any other conduct prohibited by the Act
•    advance equality of opportunity between people who share a “protected characteristic” and people who do not share it by:
- removing or minimising disadvantages experienced by people because of their protected characteristics
- meeting the needs of people with protected characteristics
- encouraging people with protected characteristics to participate in public life
•    foster good relations between people who share a protected characteristic and people who do not.

3.2    In exercising the statutory power to amend the GLA Designation Orders for GLA Roads and GLA Side Roads as set out in this decision, the decision-maker (here the Assistant Director of Transport, Infrastructure and Connectivity) must have regard to the matters set out in section 149 Equality Act 2010. This amendment is an administrative correction and will have no equalities implications.

4.2    Should the order not be corrected, current discrepancies will continue.

4.3    The original order is consistent with the Mayor’s Transport Strategy. This clarification has no material link to Mayoral strategies or priorities. 
c) impact assessments and consultations 
4.4    The Borough has confirmed it supports this clarification being made. No further consultation is required.  
d) Conflicts of interest
4.5    There are no conflicts of interest to note for those involved in drafting or making this decision.
 

5.1    The making of this change to the Designation Order has no additional financial implications for Transport for London, being contained within the operations funded under their Business Plan.  There are no additional financial implications for the GLA or GLA Group.

6.1    The GLA is empowered, by virtue of section 14B of the Highways Act 1980 (as amended by section 261 of the GLA Act (1990), to make the proposed GLA Roads Designation Variation Order with the consent of the relevant London Borough. Such consent has been given. London Borough of Hillingdon’s signed Declaration is attached at Appendix D.

7.1    Transport for London Traffic Orders team will notify the London Borough of Hillingdon of the outcome.
