Delegation to Chief Executive Officer: National CT Grant Spend

Key information

Reference code: PCD 740

Date signed:

Decision by: Sophie Linden, Deputy Mayor, Policing and Crime

Executive summary

MOPAC receives from the Home Office Counter Terrorism (CT) grants which are allocated by the National CT Policing HQ into specialist units across the country, the largest of which is the CT Command in London. The CT policing grant and priorities are governed under the national CONTEST strategy through a Home Office chaired Police Counter-Terrorist Board.

It is proposed that the Deputy Mayor for Policing and Crime, under paragraph 1.7 of the MOPAC Scheme of Consent and Delegation (October 2016), delegate to the Chief Executive Officer of the Mayor’s Office for Policing and Crime the authority to take decisions on the CT grant-funded expenditure on covert capabilities. For a period when the MOPAC Chief Executive Officer may be absent, the delegation should extend to the MOPAC Director of Strategy. This is an amendment to PCD 134 which delegated this function solely to the Chief Executive Officer.

Recommendation

The Deputy Mayor for Policing and Crime is recommended to delegate, under paragraph 1.7 of the MOPAC Scheme of Consent and Delegation (October 2016), to the MOPAC Chief Executive Officer or, should the Chief Executive Officer be absent, the Director of Strategy, the authority to take decisions on the CT grant-funded expenditure on covert capabilities.

2. Issues for consideration

2.1 Approving the delegation to the Chief Executive Officer of MOPAC will meet the requirement for decisions relating to contract awards and/or to approve funding for the CT function and the MPS’s CT Command funded from the Home Office grant, which focus on covert activities and where there is a requirement to have Developed Vetting (DV) to discuss these decisions with officers from the CT Policing function. Extending the delegation to the Director of Strategy would

2.2 Delegation to the Chief Executive Officer of MOPAC, does not remove the DMPC’s right to be sighted on all MOPAC contract awards and variations. Under the Scheme of Delegation and Consent section 4.14, the DMPC reserves the right to call in any contract award for £500,000 or above and all contract variations and extensions to contracts with an original value of £500,000 or above.

2.3 In order to provide for periods when the Chief Executive Officer may be absent, it is proposed that there be a further standing delegation to the MOPAC Director of Strategy, allowing for continuity and the expediency of business.
