Executive Summary:  

This paper seeks approval for MPS to initiate procurement for the re-provision of the two PSD Construction Frameworks (MPS Building Works Framework and MPS Construction Professional Services Framework).  

The paper also seeks approval to extend the existing frameworks for up to 12 months with an uplift of their contract spend threshold to provide resilience and continuity to deliver the 2025/26 capital plan. 

Recommendation:  

The Deputy Mayor for Policing and Crime is recommended to:   

  1. Approve the procurement of two new PSD Construction Frameworks;  

  1. Delegate authority to the Director of Commercial Services to procure and award the new framework agreements;  

  1. Approve the extension by up to 12 months duration and up to a 50% uplift in the maximum threshold value to the MPS Building Works Framework; and 

  1. Approve the extension by up to 12 months duration and up to a 50% uplift in the maximum threshold value to the MPS Construction Professional Services Framework. 

PART I - NON-CONFIDENTIAL FACTS AND ADVICE TO THE DMPC 

  1. Introduction and background 

  1. Construction works and services required by PSD at present are appointed using the Professional Services Framework and Building Works Framework, which were approved by MOPAC following a compliant procurement exercise with award of two four-year term frameworks in late 2022, expiring in early 2026.  There is now a need to replace these frameworks to support the delivery of planned Estate Strategy projects and programmes of work from 2026 to 2030.     

  1. Issues for consideration 

  1. Delivery of the Estates Strategy requires the PSD Real Estate Development team to deliver a programme of works and manage significant capital investment in the estate. Having compliant routes to market and an established supply chain of pre-qualified suppliers offering value for money is essential to deliver the Strategy and associated capital programme. 

  1. Using third-party frameworks would be a risk due to the additional procurement time and staff resources required to further compete, evaluate and award each project, with long-lead in times necessary for new suppliers to secure MPS security vetted resources. Alternative frameworks also incur management fees which result in additional costs to those organisations using the framework. These costs and additional time to procure from third party frameworks make this a less efficient and cost-effective option for the large volume of low to medium value schemes delivered by PSD.

  1. Financial Comments 

  1. The frameworks do not commit the MPS to any expenditure. All future proposals to utilise the frameworks will be approved via existing governance arrangements. 

  1. The MPS assure that any costs associated with the procurement exercise will be met from existing PSD and Commercial budgets. 

  1. Legal Comments 

  1. The Mayor’s Office for Policing and Crime (“MOPAC”) is a sub-central contracting authority as defined in the Procurement Act 2023 (“the Act”).  All awards of public contracts for goods and/or services valued at £0.215m (inclusive of VAT) or above and all awards of public contracts for works valued at £5.373m (inclusive of VAT) or above must be procured in accordance with the requirements relating to above-threshold contracts set out in the Regulations or the Act, as relevant. This Report confirms the requested frameworks shall be procured compliantly. 

  1. Paragraph 4.8 of the MOPAC Scheme of Delegation and Consent provides that the Deputy Mayor for Policing and Crime (DMPC) has delegated authority to approve business cases for revenue or capital expenditure of £500,000 or above. 

  1. Paragraph 4.13 of the MOPAC Scheme of Delegation and Consent provides that the Deputy Mayor for Policing and Crime (DMPC) has delegated authority to approve all requests to go out to tender for contracts of £500,000 or above.   

  1. Regulation 72 permits MOPAC to modify a contract in limited circumstances where certain conditions are met. MPS assure that the conditions have been met. 

  1. Commercial Issues  

  1. The MPS assure the procurement of these frameworks will be procured compliantly under the new Procurement Act 2023.  

  1. The Frameworks will be procured with regard to the Government’s new National Procurement Policy Statement (upon publication in 2025), social value procurement policy notices and key ambitions within the London Mayor’s Responsible Procurement Policy 2022-2024. 

  1. MOPAC’s strategy to consider collaborative arrangements with the rest of the GLA family will be supported as the new frameworks will be procured on the basis that they are ‘open’ to the wider GLA authority family.  

  1. GDPR and Data Privacy 

  1. MOPAC will adhere to the Data Protection Act (DPA) 2018 and ensure that any organisations who are commissioned to do work with or on behalf of MOPAC are fully compliant with the policy and understand their GDPR responsibilities.

  1. Equality Comments  

  1. MOPAC is required to comply with the public sector equality duty set out in section 149(1) of the Equality Act 2010. This requires MOPAC to have due regard to the need to eliminate discrimination, advance equality of opportunity and foster good relations by reference to people with protected characteristics. The protected characteristics are: age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation.
