PCD 1554 Uplands Lease Extension

This paper seeks approval for the extension of the current lease arrangement for the Emergency Response and Patrol Team (ERPT) at the Uplands Business Park in Waltham Forest until December 2027.  The cost of the extension is provided for within existing budgets.

The Deputy Mayor for Policing and Crime is recommended to:   

  1. Agree to the proposal to enter into a revised lease agreement to extend the MPS’s current occupation at Uplands Patrol Base to December 2027 

PART I - NON-CONFIDENTIAL FACTS AND ADVICE TO THE DMPC 

  1. Introduction and background  

  1. MOPAC approved the existing lease for this site – Uplands Business Park in Waltham Forest until October 2025 – PCD1112.  

  1. Issues for consideration 

  1. The North East Basic Command Unit (NE BCU) has capacity issues and the MPS has a project in progress to address this. The proposed extension of the lease to December 2027 will provide a further period for the continued provision of the Emergency Response and Patrol Team (ERPT) function whilst alternative locations are assessed. 

  1. Financial Comments 

  2. The MPS has budgetary provision to meet the costs of the current and expected rent review.  

  3. Legal Comments 

  4. In carrying out its functions, the MOPAC may, under paragraph 7, Schedule 3 of the Police Reform and Social Responsibility Act 2011 “do anything which is calculated to facilitate, or is conducive or incidental to, the exercise of the functions of the Office”.  This includes, entering into contracts and other agreements, in addition to acquiring and disposing of property (including land). The MOPAC has the power to renew a lease under paragraph 7(2)(b) of Schedule 3 of the “the Act”. 

  5. Under paragraph 4.16 of the Scheme of Delegation, the Deputy Mayor for Policing & Crime is required to approve the acquisition of a lease with a value above £500,000 over the initial lease period or 5 years whichever is the lesser. 

  6. GDPR and Data Privacy  

  7. MOPAC will adhere to the Data Protection Act (DPA) 2018 and ensure that any organisations who are commissioned to do work with or on behalf of MOPAC are fully compliant with the policy and understand their GDPR responsibilities.   

  8. The MPS assure that this proposal does not use personally identifiable data of members of the public, so there are no GDPR issues to be considered. 

  9. Equality Comments    

  10. MOPAC is required to comply with the public sector equality duty set out in section 149(1) of the Equality Act 2010. This requires MOPAC to have due regard to the need to eliminate discrimination, advance equality of opportunity and foster good relations by reference to people with protected characteristics. The protected characteristics are: age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation. 

  11. The MPS assure that there are no equality or diversity implications arising from this extension to existing arrangements.
