We will keep a log of the times you say it was not written down so you are not going to be able to get it under FOI. I may have used the term `excluded- inappropriately. I accept that there are parts of this organisation where the Director of Secretariat would not naturally be included. However, showing a practical attitude to it, would you recommend that I talk to your office about how we can actually work with them during this process instead of them spending five months and producing a huge file?

There are indeed those protections under the Act. I thought you would say yes, I hoped you would say yes, and I believe the Commissioner for Transport would agree with all that. One of the questions that my group has asked ' and we are trying to be quite discriminating in asking questions ' is about the performance targets set for the Commissioner. On the basis that I do not think every document usually does come into the public domain, I know that from the experience of officers in Kensington and Chelsea trying to drag information out, would you agree that all documentation, whether or not TfL has put it in the public domain, would be made available?

The business case, the modelling case, every bit of the facts and figures associated with TfL's decision to push for an extension. You said that if we found the money, you would make the information available. I am asking you to confirm that today.

In the interests of access to information, can I just remind you that you very helpfully, I think, indicated that you would be happy for the Transport Committee to pay for an independent audit of all the papers, facts and figures connected to the western extension so that we could see for ourselves in our own way and not just in TfL speak whether the case stacks up. Can I ask you whether you would be happy to confirm that I am right in what I am assuming you said?

One of the sets of information that exists is the Mayor's Management Board agendas and minutes. We have asked for those where the Director of Secretariat was excluded from the meetings. We have not had a refusal. We have been told we will receive a full response by 15 June 2005. Do you agree that given the responsibilities of the people who attend that meeting that the way your policies are implemented is a matter of public interest?
