This paper seeks approval to accept a GLA offer of grant funding of £998,646 to undertake design stage work for the decarbonisation of Empress State Building (ESB), and to procure the necessary project management and technical design expertise.
The Deputy Mayor for Policing and Crime is recommended to:

Approve the receipt and expenditure of a GLA Grant Funding award for ESB Decarbonisation design and project management consultancy services not exceeding £998,645.90.

Approve that these services be procured via compliant MPS frameworks, and for delegated approval to be granted to the Director of Commercial Services for award of consultancy service contracts.

Introduction and background

Empress State Building (ESB) comprises 8-9% of the MPS estate carbon emissions.

Issues for consideration
-
The ESB heating system is nearing the end of its life and needs replacing. The MPS has budgeted to replace the gas boilers with like-for-like.

The adjacent land owner Earls Court Development Company (ECDC) - a joint venture of Delancy and Transport for London - are considering a plan for a decarbonised, zero emissions and zero carbon heat network for their development.

There is a opportunity to join up the ESB need/demand with the adjacent land owners proposed development. In order to do this technical designs need to be developed.

The GLA has agreed funding from its Green Finance programme to undertake a series of design stages.

Financial Comments

The grant offer from GLA is £998,646. The grant will be used to procure design and project management consultancy. There is no expected call on MOPAC/MPS budget for this proposal.

Legal Comments

The MPS Directorate of Legal Services confirm that the route to market is compliant with public contract regulations.

Paragraph 4.8 of the MOPAC Scheme of Delegation and Consent provides that the Deputy Mayor for Policing and Crime (DMPC) has delegated authority to approve all bids for grant funding made and all offers made of grant funding, and to approve business cases for revenue or capital expenditure of £500,000 and above.

Paragraph 4.13 of the MOPAC Scheme of Delegation and Consent provides that the Deputy Mayor for Policing and Crime (DMPC) has delegated authority to approve all requests to go out to tender for contracts of £500,000 or above.

Commercial Issues

The technical design and project management consultancy will be procured via existing MOPAC-approved frameworks.

The MPS assure that as part of their appointment onto the MPS frameworks, the delivery partners the MPS will use to deliver the design for the Decarbonisation of ESB to RIBA Stage 4 have committed to take specific actions to address the LAIC objectives. The contracts will encourage the use of London supply chain specific initiatives including: apprenticeship levies; adherence to modern slavery and London Living Wage obligations; social value impact opportunities.

GDPR and Data Privacy

MOPAC will adhere to the Data Protection Act (DPA) 2018 and ensure that any organisations who are commissioned to do work with or on behalf of MOPAC are fully compliant with the policy and understand their GDPR responsibilities.

The MPS assure that this proposal does not use personally identifiable data of members of the public, so there are no GDPR issues to be considered.

Equality Comments

MOPAC is required to comply with the public sector equality duty set out in section 149(1) of the Equality Act 2010. This requires MOPAC to have due regard to the need to eliminate discrimination, advance equality of opportunity and foster good relations by reference to people with protected characteristics. The protected characteristics are: age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation.

The MPS assure that there are no negative equality or diversity implications arising from this proposal negating the requirement to present any mitigation. Any approved suppliers will be evaluated for acceptable equality and diversity statements, as well as their ability to meet the MPS requirements under the Equality Act 2010 as suppliers to MOPAC.
