The new planning guidance encourages local authorities to meet the existing 16 week statutory timeframe to determine oil and gas planning applications. If Government decide to intervene in any such applications in London (e.g. for exceeding the statutory timeframe), then environmental protection provided by existing regulations, permits and planning requirements for shale gas exploration would still need to be complied with. However, from geological surveys undertaken to date it seems unlikely that there is any exploitable shale gas or oil in the London region and therefore unlikely that fracking will take place under London.
