Question

The recently passed Infrastructure Act gives the Mayor of London power to create Mayoral Development Orders. Can you please explain the difference in practice between an MDO and a Local Development Order that can be created by a local authority? Are MDOs subject to the same guidance under the NPPG?

The Government will make Regulations to set out the scope of MDOs and the procedure for preparing them. MDOs are anticipated to function in effectively the same manner as an LDO, with the difference being that MDOs are prepared by the Mayor following a formal request by a borough. A borough’s consent is also required in order to consult and adopt an MDO. It is expected that the National Planning Practice Guidance will be updated to reflect these changes.
