The MPS informs me that current road traffic legislation means that a person must be 'unfit' to drive through drugs before an arrest can be made. This can only be determined by a Field Impairment Test (FIT). The Association for Chief Police Officers (ACPO) are seeking a change in the law to make it an offence to have taken a proscribed drug, such as heroin or cocaine, and drive - removing the "unfit" element.

FIT testing has only been in operation since April 2007. In 2007, a total of 18 drivers were arrested by Traffic Officers following a FIT test. This figure increased to 42 in 2008 and so far this year 20 drivers have been arrested for driving whilst unfit through drugs.
