Question

Given the failure of TFL's contractor BBCJV to adhere to Lewisham's Code of Construction Practice until recently (especially with regards to adequate dust monitoring, capping dust mounds and putting up adequate wooden fences) how will you compensate New Cross residents who have been put at risk from work on contaminated land at the ELL site over the past 18 months?

The Code of Construction Practice was developed by TfL in consultation with Lewisham and other Local Authorities along the route. TfL's main works contractor, Balfour Beatty Carillon, is required to adhere to this code, and we believe that this has been the case. Officers of the London Borough of Lewisham have regularly attended the site to review the status of the works and the environmental controls that have been, and continue to be, employed. TfL has adhered to the code in the Lewisham area and fulfilled its obligations.
