Question

I understand from local campaigners that the project to build a new ice rink in Streatham High Road is being delayed because TfL has failed to give permission in writing for 1) the use of a section of pavement for crossing into the new development and, 2) the moving of a bus turning facility. Has TfL given written permission on these two issues? If not, why not?

TfL's involvement in the project revolves around an exchange of land with the developer of the site, providing the developer meets conditions set out in a legal agreement. This legal agreement (between what was then London Transport and Laws Estates, the developer of the Streatham Hub site) was made in 1997, when a major part of the Streatham bus garage was sold to Laws Estates prior to further sale to Tesco. The legal agreement was transferred to Tesco at the time of the re-sale. There was an option (valid for 21 years from the date of the agreement) for Tesco to purchase a small part of the site that is currently used as a bus terminus and that was excluded from the main sale. This is dependent however on TfL being provided with a suitable alternative facility to an agreed specification at Tesco's cost. TfL has not yet been provided with a suitable alternative facility, and where this is provided TfL will give permission for the land exchange to occur. Responsibility for any delays in the scheme therefore rest firmly with the developer.TfL is also in discussion with the developer's consultants to agree highway improvements to the A23 Streatham High Road in connection with the development and in accordance with a Section 106 Agreement. This includes access to the development and the bus turning facility. Both have been agreed in principle and are currently with the developer's consultant to respond to TfL on outstanding matters of detail. Following this, formal agreement will be entered into through a section 278 agreement.
